TERMS AND CONDITIONS
Introduction
The following document details the terms and conditions that the client is obliged to accept when generating a contract with the Travel and Tourism Agency - tour operator Natural Explorer Tours (hereinafter referred to as The Company). By booking a trip, tour or other service, the client accepts that he will be bound by these Terms and Conditions, which describe, among other things, our cancellation policy and certain limitations of liability at the time of making your reservation.
Contract
To enter into a contract with the company, the client declares that he or she is of legal age (18 years old) and has the necessary legal capacity to contract the services offered by the service providers. He or she also declares that he or she accepts the obligation to be bound by this agreement and understands and fully accepts the conditions stated herein for using the digital media and contracting the services offered.
The contract is between Natural Explorer Tours (also known as the company) and the client, who is the person traveling or intending to travel on a tour operated by the company. The client is required to have read and understood our travel policy as stated below. By making a reservation by phone, or through the website, social media, email, or other means, the client accepts and is bound by these Terms and Conditions. If you are interested in making a reservation with us, you must have read and understood all the clauses contained in this document. By signing a travel agreement with us or any of our agents, you automatically accept the booking conditions on your own behalf, as well as on behalf of the persons included in the reservation, regardless of whether they are minors or have disabilities. The contract becomes valid once the client has made full payment of 100% of the value of the tour, service, or product required.
These conditions apply only to services in our program and not to international and domestic flights. These are subject to the conditions imposed by the airlines. The same applies to lodging and dining establishments.
Travel costs
The company is authorized to increase the price of any package when it deems appropriate without prior notice or notification to customers. New rates are evaluated taking into account various factors, such as currency fluctuations, government actions, food costs, transportation costs, fuel costs, airport fees, ticket prices, or any other costs beyond the company's control.
Responsibilities
The Company assumes no responsibility for force majeure due to weather conditions, natural phenomena, and social conflicts that may occur before or during the trip, or for any eventuality that may make any trip uncomfortable or difficult, or for any delay or obstruction to your trip in any way, and does not guarantee the failure on the part of the company, whether in full or partial execution of the services it has undertaken to provide, which may have been affected by the aforementioned factors.
We cannot accept any responsibility for cancellations or delays to any of your flights, whether the cancellation or delay is due to adverse weather conditions, airline rescheduling, airport authority and/or air traffic controller action, mechanical failure, or industrial action.
Our company will do its best to accommodate your travel itinerary, ensuring that any issues are resolved and nothing is affected by flight delays.
The Customer must understand and be flexible if problems cannot be resolved due to flight delays.
Policy on children and/or minors
On all services offered, the maximum age for a child is 3–10 years old. Children 11 and older are considered adults. Therefore, children under 3 years old do not pay for the service or occupy a seat; children 3–10 years old receive a 10% discount; and children 11 and older pay the full price.
The responsibility for minors lies solely with their parents or guardians.
Photography, videos and testimonials
If we inspect or take any images of you during the tour, we have the right to use them in our advertising campaigns free of charge. This includes all types of promotional materials such as slides, video programs, brochures, and online and social media content. If you have provided us with any written comments, whether physical or virtual, these may also be used for promotional purposes. In order to comply with Peruvian law and company policies, we request your cooperation in authorizing the use of your image, voice, and/or reactions. Therefore, by using our services, the client freely and voluntarily authorizes Natural Explorer Tours SRL to expressly and irrevocably, free of charge, and permanently, use their image, voice, and/or reactions, so that they may be incorporated and disseminated in audiovisual, graphic, and/or virtual media for advertising purposes.
This authorization is granted within the scope of Article 15 of the Civil Code and Law No. 29733.
Age, physical condition and participation
Before booking a tour, you must be absolutely certain that you have the required level of fitness and that you will be able to complete the entire chosen travel itinerary. If you are over 60 years of age, we strongly recommend that you obtain medical advice confirming that you have acceptable strength and physical condition.
The company will not allow anyone under 18 to travel alone. If a person is in their teens, they will only be considered if they have a parent or guardian with them who assumes full responsibility.
The company may decline any reservation if it deems it appropriate. You must abide by and accept the decisions made by our employees, agents, and leaders during the tour.
If any person's health or conduct before or after departure appears to endanger the comfort, safety, and happiness of other guests, that person may be excluded from all or part of the tour. Additionally, if a traveler's health is not adequate, the company may make necessary accommodations for them, but this is not mandatory.
Poor health or disability
If you suffer from any illness or disability, are undergoing medical treatment of any kind, or have any other medical problem that the company needs to be aware of, you must inform us when you make your booking. Clearly indicate the nature of your condition and submit a request for any medication or treatment you may require during the tour. Failure to inform us of such a situation would imply a breach of these booking conditions, which may result in your exemption from the tour. In all these cases, no refunds of any kind are given. Additionally, if your tour includes boat transportation, you must inform the company if you are unable to swim when you book the tour. You will not be prevented from participating in the tour.
Incidents and accidents
Any risky situations that may arise during the tour are accepted by the client; however, the company recommends taking precautions to avoid situations that could lead to incidents and/or accidents. If, for reasons beyond its control, an incident and/or accident should occur during the tour, the company is not responsible for any damages caused to the client and/or third parties.
Customer Responsibility
As a client, you must accept the decisions made by company employees, agents, and leaders before and during the trip. If any person's health or conduct before or after departure appears to jeopardize the comfort, safety, and happiness of other clients, that person may be excluded from all or part of the tour.
If a traveler's health is not adequate, the company may make the necessary arrangements for them, but this is not mandatory. The costs incurred in this regard must be borne by the customer.
If a client does anything illegal, they will be excluded from the tour, and the company will not be held responsible. Also, if you have a specific medical condition that may affect other people's enjoyment or prevent you from participating in the tour, please inform us when booking a tour.
No refunds are issued for unused facilities or services. As a client, it is your sole responsibility to have a valid passport, visa, and any other necessary documents or medications during the tour.
Clients accept that the company assumes no liability for failure to provide the services offered in the event of adverse weather conditions or unforeseen natural disasters. Clients also acknowledge that they will not be liable in the event of political unrest, accidents, declarations of a state of emergency, border closures, strikes, or any other public event beyond their control that could not be foreseen. In these cases, the value of the contracted service will not be refundable.
Clients must carry their ID (DNI) or foreigner's card throughout the tour. They must remain within the group. They must also have communication equipment to stay in touch with the guide or tour manager in case they become separated from the group. They must also provide an emergency contact person for the agency to contact in case of any extraordinary event, incident, or accident during the tour.
Always carry your belongings safely, as the agency is not responsible for any loss of property of any kind.
PAYMENT, CANCELLATION AND REFUND POLICIES
The Company guarantees a reliable and secure platform, backed by online security standards. You can rest assured that your payments will be processed safely and securely.
Reservations, payments, deposits and surcharges
To make a reservation, the customer must make full payment (100%) for the value of the service or product required. This applies only to exceptional cases indicated by the company.
Payments can be made through digital channels such as Yape, Plin, Deposit, or Interbank Account. For payments from abroad in cash or deposit, through banks or remittance agents, the customer assumes the transaction cost.
The company accepts Visa, MasterCard, American Express, and Diners Club credit, debit, and prepaid cards; the customer assumes the additional 5% transaction fee.
When paying by card in a currency other than the quote provided, the customer will be responsible for any differences in exchange rates applied by their bank.
For cash payments, bank transfers, and/or bank deposits in a currency other than the quoted currency, the customer accepts the company's exchange rate.
If the customer makes a payment by card, the company reserves the right to request a copy or photo of the card used for payment, showing only the following information: the first four digits, the last four digits, and the cardholder's name; in addition, the cardholder's passport or ID to prevent fraudulent transactions. If the cardholder will not be part of the travel party, they must send a letter by email, which must be signed, indicating that they authorize the charge to their card.
The aforementioned surcharges for any type of payment, deposit, or other transaction will be borne by the customer.
Once payment (Yape or Plin), deposit or interbank transfer has been made, the client must send the receipt to the cell phone number: +51 922128457 and/or to the email naturalexplorertours@gmail.com to validate and confirm the reservation.
Reprogramming
For any rescheduling by the customer, with at least 7 days remaining before the start date of the contracted service, the request will be accepted provided the customer has no outstanding balances due, the third-party provider involved allows it, and there is no difference in rates for the new rescheduling date.
Rescheduling will not be accepted if communicated less than 7 days in advance if the company will be operating directly.
In cases where the tourist destination does not allow rescheduling to the requested new dates, the company will search for available dates that must be accepted by the client; otherwise, the service will be forfeited without any claim.
Refunds
No refunds will be issued after the customer has made payment and decides to cancel the reservation.
Pricing errors
Prices provided by the company or our travel service providers provide the prices and other information related to the services. If any of the related or provided services are incorrectly priced or contain incorrect information due to typographical errors, or if any other errors occur in the prices or service information, we reserve the right to refuse or cancel reservations for that service.
Cancellations or no-shows
If the client decides to cancel or cancel the reservation, no refund will be issued. Failure to show up on the day and time indicated for the contracted service carries a 100% penalty; in other words, no refund will be issued. In any case (cancellation, rescheduling, and refunds), if a contracted service is provided by a third party, the third-party operator's policies will apply.
The customer hereby declares that they have read and understood the Terms and Conditions indicated above, in addition to the terms of sale, payment, refund, and surcharge as indicated by the company on the website, social media, brochure, form, or other means provided, and that they are fully aware of and confirm this statement. They have taken the time to read the Booking Terms and Conditions. They have fully understood all clauses and fully agree to all of them.
